April 8, 2009: Research shows that the most dangerous time for a victim of domestic abuse is when he or she is trying to separate from or leave the other party. Sadly, an extreme example of this was seen late yesterday in Alabama. Below you will find links to articles telling you how to make a safety plan if you are a victim of domestic abuse. Family lawyers can share these articles with clients who have a need for the materials.
An Associated Press article states that in Priceville, Alabama, a man is alleged to have shot and killed his estranged wife, their daughter and two other relatives before burning down his house and committing suicide. The slayings took place the night before the husband and wife were to appear in court for a divorce trial. Papers filed during the divorce by Kevin Garner's wife accused him of being abusive. However, no action was taken to ensure the safety of Mrs. Garner and her family.
According to the AP, Tammy Garner filed court documents show seeking custody of their daughter. She alleged that her husband "has been both physically and emotionally abusive." Mr. Garner’s sister, Karen Beaty, took the side of her brother's estranged wife. The two women and their children were living together before the trial. Officials say that Beaty and her son might have been on the witness list for the divorce case. Both were killed by Garner.
