Thanks to Dorothy Hague who points out that there is a new procedure for filing motions in Wayne County. She explains the new procedure:
Get a copy of the Court Directives, most recent edition.
Find out whether the FOC or the Judge deals with this issue...most likely, of course, the FOC. Wayne County FOC website is here.
Find out who the Judge is and then the Referee, and get the most recent [last July] schedule for hearings before the referees [Judge McCarthy always has same on the Attorneys Table [1501 CAYMC]
Prepare your motion
Go to the 9th floor of the CAYMC, 928, stand in line with a check for your motion fee, Motion, Praecipe, Affidavit from parties, and file Motion. [Note: Bring more than one copy of all docs i.e. 3 copies of Motion should be good. Also, only attorneys' office can use a check for the motion fee.]
Then go to room 900a in the area between the City and the County sides, and stand in line and get a hearing date and time.
Finally, serve everyone with notice of hearing, motion, certificate of service, etc.
Ms. Hague notes that she uses a runner to do the filing (sounds like a great idea!) and advises that you use one apprised of this new procedure at the 3rd Circuit Family Division.
